In this Privacy policy you will find information about how we at Fumex AB (referred to as “Fumex” or “we”) process your personal data.
Fumex is committed to your integrity and always strives to protect your personal data in a careful and responsible manner and to comply with applicable data protection regulations, such as the General Data Protection Regulation (referred to as “GDPR”).
The purpose of this policy is for you to receive information about how we process your personal data, so that you can feel secure when you purchase from us, use our applications, or otherwise communicate and act with Fumex.
1. Who is responsible for the personal data we process about you?
Fumex AB, 556190–5729, is the data controller responsible for your personal data. You may contact Fumex if you have questions regarding our personal data processing. Our contact details can be found below under ”Contact details”.
2. What is personal data and the processing of personal data?
Personal data is all information that can directly or indirectly be linked to a living person. This may include information such as name, email address, telephone number, personal identity number, and login details. Images and sound recordings can also be personal data even if no names are used. Encrypted data and various types of electronic identities such as an IP number, IP address, or information about your computer or mobile device can be personal data if they can be linked to you as a person.
Processing of personal data is all types of processing, such as collecting, storing, using, sharing, deleting, and changing.
All processing requires a legal basis. A legal basis can, for example, be the performance of a contract with you, our legitimate interest, your consent, or a legal obligation.
3. What personal data do we process about you?
Business and customer relations
When you communicate with us as a representative of a business or business partner of Fumex, we may process your personal data. We need to process the data to be able to administer the relationship, such as handling purchases, price inquiries, deliveries, and otherwise performing in line with contract with your organization.
The legal basis for this processing is the performance of the contract with the organization you represent.
When you contact us via a web form or otherwise communicate with us
We may process your personal data if you contact us via our website’s form or email us for questions or requests for information. The data we process is your contact information (Name, Email address, and Telephone number) and other information you choose to provide in the message or e-mail. This processing is necessary to administer and respond to your request.
The legal basis is your consent.
When you use the FUMEX application
We may process your personal data when you use our mobile application. The data we process is your IP address and information about your device. We process this data to be able to deliver and ensure the app’s functionality and performance, as well as to locate the country the app user is in. We save your data as long as the app is installed on your device.
The legal basis for the processing is performance of contract.
The FUMEX application uses your device’s camera to be able to position and optimize the app’s function.
It is important to note that the camera only displays real-time. The app does not record video and therefore does not save any video, image, or audio from the camera. No image or audio data is transferred from your device or stored by Fumex or any other third party.
Therefore, no personal data in the form of stored video, image, or audio from the camera is processed.
4. With whom may we share your personal data?
We will not sell or rent your personal data to anyone else.
However, we may share your personal data with affiliated companies within the Fumex group, licenses of Fumex, and business partners with whom Fumex has entered into agreement.
We may also share your personal data with service providers we engage to provide our services, applications, and goods to you. For example, software providers, technicians, subcontractors, and distributors, etc.
For our FUMEX application, we use Unity Technologies, which is a software provider and responsible for the development and maintenance of the app. Unity Technologies collects certain technical data about your use of the app, which includes your IP address and information about your device. For information on how Unity Technologies processes your personal data, we refer to their own privacy policy.
In cases where we share your personal data with third parties as described above, it is only done to the extent necessary, and we do not share more data than necessary. Sharing data with a third party is only done so that such third party can perform the tasks we have assigned to them. All processing by third parties is done in accordance with Fumex’s instructions, and we do not allow any third party to use your personal data for other or their own purposes.
We may disclose your personal data to an public authority if Fumex is obliged to do so by law.
5. Where do we process your personal data?
We primarily strive to process your personal data within the EU/EEA.
However, there may be situations where we use partners or service providers who in turn may process your personal data outside the EU/EEA. Since countries outside this area do not always have the same statutory level of protection as within the EU/EEA, we take the necessary and appropriate measures to ensure that your data is transferred and handled securely and with an adequate level of protection in accordance with applicable data protection legislation like GDPR.
Through these measures, Fumex ensures that your rights as a data subject are protected in case of data being transfer outside the EU/EEA.

Right of access: You have the right to know whether we process your personal data, what personal data we process about you, and how we process your personal data. If you want access to this information, you can request to receive it in a compiled register extract.
Rectification and Erasure: You have the right to request rectification of personal data we process about you, if they are inaccurate or incomplete. You also have the right under certain circumstances to request that we erase your personal data or restrict our processing of your personal data if, for example, it is no longer necessary for us to process your personal data, if our processing is based on your consent and you withdraw this consent and there is no longer a legal basis for our processing, or if you object to our processing of your personal data for direct marketing purposes. Our ability to fulfil a request for erasure may be limited if we have a legal obligation to retain them.
Right to data portability: If our processing is based on your consent or if the processing is necessary for us to fulfil a contract with you, you have the right to request that the data you have provided to us be provided to you in a structured, commonly used, and machine-readable format. You also have the right to transmit such data to another data controller.
Right to restriction of processing: Under certain conditions, you have the right to request that we restrict our processing of your data. This means that we mark the data so that in the future we only process them for certain specific purposes.
Right to object: You have the right to object, for example, to the processing of personal data that takes place based on a balancing of interests, such as our legitimate interest.
Right to lodge a complaint: If you wish to complain about our processing of your personal data, we hope you contact us directly so that we can correct the error. However, you always have the right to lodge a complaint directly with a supervisory authority. The correct supervisory authority is the authority in the EU Member State where you have your habitual residence or the place where the alleged infringement took place. You can always send your complaints to the Swedish supervisory authority, the Swedish Authority for Privacy Protection (IMY), which in turn can refer the case to the correct Member State authority, if they are not the correct authority themselves.
